ECHR says it passed 11 judgements for Serbia in 2021

The European Court of Human Rights (ECHR) passed 11 judgements on 29 filings by Serbia in 2021, a press release said on Tuesday.

„For Serbia in 2021, the ECHR has delivered 11 judgments on 29 applications and declared inadmissible or struck out 1,933 applications,“ it said and added that some of the applpications were joined and covered by one judgement.

„In 8 of the judgments at least one violation was found, in three judgments no violation was found. The violations concerned prohibition of discrimination (3 out of 8 judgments), lack of effective investigation, right to liberty and security, length of proceedings and non-enforcement of judicial decisions,“ it added.

According to the press release, 1,993 new applications were filed in 2021, more than the 1,836 in 2020, but less than the 2,106 new applications in 2019.

It said that Serbia has 2.90 applications per 10,000 population which is more than five times the European average. It also ranks 8th of 10 countries with most cases pending.

The press release said that the Serbian authorities were informed of 1,025 of the applications compared to 466 in 2020.

It recalled that 232 judgments were delivered for Serbia from 1959 to 2021, with at least one violation found in 207 of them. The right that was violated most was the right to protection of property (82 judgments), non-enforcement (75 judgments), and length of proceedings (54 judgments).
