The Serbian Commissioner for public information has asked the country’s Constitutional Court to assess the legality of laws on defence and on the top civilian intelligence agency.

According to a statement from Commissioner Rodoljub Sabic’s office, the Constitional Court was asked to make its assessment because the Army of Serbia (VS) and Security Information Agency (BIA) “have practically been taken out of the system allowing free access to information under the law on free access to information of public importance and the system protecting secret data”.

The Commissioner warned that the laws allow the Defence Ministry to decide which information cannot be made available to the public and classifies some BIA documents by type and not content, running counter to the constitution which allows access to information held by state bodies.
